1. GENERAL

1.1 These terms and conditions apply to all Snowplanet passholders visiting the Snowplanet Snow Dome. This includes, but is not limited to day passes, hourly passes, family passes, night passes, corporate group visits, school group visits, Santa visits, all memberships, all Winter Wonderland passes, birthday parties, events, camps and programs. Each of these are considered a “Pass” and by purchasing a Pass and/or entering and using the Snowplanet Snow Dome, you are deemed to have accepted these terms and conditions, and you agree to be bound by them. Passholders are permitted to use Snowplanet’s Snow Dome only in accordance with these terms and conditions.

1.2 Structured Programs
Snowplanet offers structured coaching, academy, skills, race, freestyle and athlete development programs (“Programs”). Programs are governed by separate Program-Specific Terms & Conditions, which apply in addition to these General Terms & Conditions and any program-specific conditions published on the relevant program page. By enrolling in a Program, you agree to be bound by the Program-Specific Terms & Conditions as well as these General Terms & Conditions.

1.3 Snow sports have many hazards and risks associated with them including slips, trips and falls, collisions with other participants and collisions with man-made objects. Injuries are a common occurrence in these sports. The safety of the participant is directly affected by their judgement, the deliberate and conscious control of their physical ability, and the proper use of equipment.

2. RFID CARDS & ACCESS

2.1 Each passholder will be issued with a unique RFID (Radio Frequency Identification) card linked to their Snowplanet profile. The RFID card is necessary to activate the gates that allow access to the platter lifts and the ski mat. RFID cards must be carried by the passholder at all times while using the Snow Dome. Access to the lifts and ski mat will not be granted to passholders who do not possess a valid RFID card.

2.2 Passholders will be charged $7 for their RFID card, which can be used each time the passholder visits Snowplanet. Passholders may obtain a full refund on returning their RFID card at any time. Faulty RFID cards will be replaced free of charge on presentation of the faulty card. Lost, stolen or damaged RFID cards must be reported immediately and will incur a further $7 charge for a replacement.

2.3 For security reasons, photo identification may be required when first collecting your RFID card, being issued a replacement RFID card, or updating your photograph. In addition, Snowplanet may use one or more gate control screens at its RFID access control gates. These screens display the photograph of the person loaded on the RFID card when the RFID card is in range of the card readers on the gates. Snowplanet uses this system to confirm that RFID cards and all Passes associated with each are used only by the correct persons.

3. PASSES & CONDUCT

3.1 Passes are non-refundable, except where permitted for specified types of Membership. Terms and conditions for Membership refunds are set out under Section 6 – Specific T&Cs for Snowplanet Memberships.

3.2 Passes and RFID cards are not transferable and may only be used by the person to whom they are issued, as recorded by Snowplanet on the Passholder’s RFID card. Any attempt to sell, transfer, advertise, or assign a Pass or Membership to another person constitutes unauthorised transfer.

3.3 A time-based Pass (including 1-hour, 2-hour, 4-hour, and similar passes) is valid from the booked start time shown at the time of purchase, regardless of the time of purchase or the time of first lift use. The Pass is valid for the full duration purchased and provides time-based access to the Snow Dome environment, including skiing, snowboarding, and Winter Wonderland activities, not a set amount of lift use or active participation only. The validity period includes all time spent during the access period, including but not limited to time spent skiing, snowboarding, participating in Winter Wonderland, assisting others, spending time in beginner areas, resting, moving around the snow space, and any time spent leaving and re-entering the Snow Dome, including for toilet breaks, food and drink, or other personal reasons. How a Passholder chooses to use their time during the validity period is at their discretion, but the Pass will expire automatically at the end of the purchased time period.

3.4 If an RFID card or Pass is used or transferred in a manner not authorised by Snowplanet, Snowplanet may revoke the RFID card and any Passes and/or memberships loaded against that RFID card without any refund payable to the Passholder and may commence legal proceedings for unauthorised access and use of the facilities. Proof of ID, including date of birth, may be requested.

3.5 Any conduct or behaviour on Snowplanet premises that is criminal, fraudulent, in breach of these Terms & Conditions, or that presents a risk to the safety of any person entitles Snowplanet to revoke the Pass without any refund. This may also include a ban from the facility, depending on the seriousness of the breach.

Only instructors authorised by Snowplanet are permitted to teach lessons in the Snow Dome.

3.6 If a person to whom a Pass has been issued provides any false information in connection with the purchase of any pass or product offered by Snowplanet (including providing an incorrect age for any infant, child, student or senior citizen, or falsely claiming student status), Snowplanet may at any time without notice revoke any or all Passes acquired by, or on behalf of, that person without any refund payable to the Passholder.

4. DEFINITIONS & ELIGIBILITY

4.1 An infant is aged under 2 years (24 months).

A child is aged 16 years or under.

A Senior Citizen is aged 65 years or over.

A Student is aged 21 years or under with a valid student ID and proof of study.

4.2 Snowplanet reserves the right to ask a Passholder or a person purchasing a Pass, whether for himself/herself, or on behalf of anyone else, for proof of age and student status at any time. The age and student status of a Passholder, when assessing eligibility for an infant, child, adult, senior citizen or student, is at the time of purchase.

4.3 A Pass issued (or reloaded) by Snowplanet to the person(s) detailed within the purchase, is considered delivery of the goods and services contracted for by the person who pays for that Pass, irrespective of method of payment. Ownership of the Pass belongs to the person named against the Pass and on the RFID card, not the purchaser, except that parents or legal guardians will own Passes they have purchased on behalf of a child (any person 16 years old or younger).

5. VARIATION OF TERMS & CONSUMER RIGHTS

5.1 Snowplanet reserves the right to vary and amend any of the Terms and Conditions relating to the Passes or other products offered by Snowplanet at its sole discretion. If any variation or amendment made by Snowplanet to the Terms and Conditions is materially adverse to the Passholder’s interests, the Passholder may cancel their Pass and, in the case of cancelled Membership Passes, Snowplanet will refund to that Membership Passholder a pro-rata amount for each complete month the Membership has remaining until such time it expires.

5.2 The above Terms and Conditions are subject to, and in conjunction with, the Consumer Guarantees Act and the Fair Trading Act, and do not affect the customer’s rights as expressed in these terms.

5.3 Credit card and contactless card payments will incur a 1.5% surcharge. There is no surcharge for EFTPOS and debit cards that are inserted or swiped.

6. SPECIFIC T&CS FOR SNOWPLANET MEMBERSHIPS

6.1 Certain Membership Passholders may qualify for a full or partial refund, or extension, in the following circumstances only, provided these circumstances preclude the Membership Passholder from being able to use the Membership Pass:
• Personal injury to the Membership Passholder;
• Severe illness of the Membership Passholder; or
• Pregnancy of the Membership Passholder.

6.2 The full or partial refund will be considered and determined by Snowplanet for the person who meets the above criteria only.

6.3 All requests for refund, or extension, must be submitted to Snowplanet in writing. Any refund value will be calculated pro-rata, based on each complete month remaining of the Membership to its expiry date from the date the Membership is deemed by Snowplanet unusable. Any refund will be made to the same party by the same method as used to purchase the Membership Pass, or by any other method as determined by Snowplanet at its absolute discretion, and the Membership Pass will be cancelled. Refunds will only apply from the date that Snowplanet receives written notification and will not be backdated to when the Membership was last used.

6.4 Full or partial refunds will only be considered against Snowplanet GOLD and BRONZE Memberships:
• GOLD Flexi Year (12 months) – Adult, Child, Student & Infant (infant must be aged 5 or under on the date the membership is activated)
• GOLD Family Year (12 months) – Minimum Three, Maximum Six Family Members
• BRONZE Year (12 months) – Adult, Child & Student.

6.5 Full or Partial refunds will not be granted against the following Memberships:
• SILVER Casual Flexi (paid monthly) – Adult, Child & Student
• Rental Membership Add-ons – Adult, Child & Student Rental Equipment + Helmet Combo Members
• Rental Membership Add-ons – Adult, Child & Student Rental Equipment Members
• Rental Membership Add-ons – Helmet Rental Members
• Corporate Memberships – Pass Only & Pass including Equipment Members.

7. MEMBERSHIP NOTES

7.1 GOLD Flexi Year (12 months) Membership Passholders may place their Membership on hold for a holiday period and restart it again without penalty. All requests to place a Membership on hold must be submitted to Snowplanet in writing at least 36 hours prior to the holiday period commencing. A holiday period must be a minimum of one calendar month in duration. A maximum of two holiday periods is permitted during the Membership term, with the total duration of holiday holds not exceeding twelve months. The Membership will automatically expire twenty-four months from the original start date, regardless of any holiday holds.

7.2 GOLD Memberships placed on hold for a holiday period can only be restarted by submitting a written request to Snowplanet. This ensures the revised expiry date can be calculated accurately and provides a clear record of hold periods in the event of any future query or dispute. Once confirmed by Snowplanet, the Membership may be reactivated at the Snowplanet Front Desk. A new expiry date will be applied to reflect the length of the holiday hold, provided that the revised expiry date does not exceed twenty-four months from the original Membership start date.

7.3 SILVER Casual Flexi (paid monthly) Memberships are administered and billed through Debit Success under a separate membership agreement between the member and Debit Success. Where a SILVER Membership is placed on hold, suspended, cancelled, or otherwise changed, this occurs strictly in accordance with the Debit Success membership terms accepted by the member at the time of sign-up.

7.4 Members may restart a SILVER Casual Flexi Membership at any time directly through Debit Success, in accordance with Debit Success’s terms and conditions. Restarting will not incur a penalty provided the membership has not been deemed cancelled under those terms. Where a membership has been cancelled, re-joining will require payment of the applicable joining fee.

7.5 During any period in which any Membership (including GOLD or SILVER) is on hold or suspended, members will not have access to Snowplanet lifts in the Snow Dome unless they first reinstate their membership in accordance with the applicable membership terms or purchase a casual Snow Pass directly from Snowplanet.

8. SNOW DOME REGULATIONS (INCLUDING THE SNOW SAFETY CODE)

8.1 The Snow Safety Code

8.2 To the maximum extent permitted by law, Snowplanet is not liable for any loss, damage or injury including direct, indirect or consequential loss suffered by any person arising out of or in connection with the use of the Pass. Use of the slope (Snow Dome), Terrain Park, Platter Lifts and Ski Mat is at your own risk. Nothing in these terms and conditions limits or excludes any right or remedies that cannot be limited or excluded, including under the Consumer Guarantees Act 1993.

8.3 Snowplanet does not accept liability for lost or damaged equipment. The use of your equipment is at your own risk. Terrain Park features are regularly maintained and inspected. Any damage incurred to your equipment in using the Terrain Park is at your own risk. (Lockers are available for hire, for bags and belongings.)

8.4 Please consider the safety of yourself and others at all times.

8.5 Parents are responsible for the safety and behaviour of their children at all times. (Except while participating in a Snowplanet program under instructor’s supervision.)

8.6 All snow sports guests should wear appropriate ski, snow or snowboard boots. For comfort, appropriate warm clothing and gloves need to be worn at all times. (Rental clothing and gloves can be hired from the front desk if required.)

8.7 Please follow any instructions or directions from our staff, they are here to ensure you make the most of your time whilst in the Snow Dome. Should Snowplanet staff feel that your safety or the safety of others is in danger at any point whilst you are participating in activities at Snowplanet, we reserve the right to remove you from the slope without providing a refund.

8.8 Please do not stop in the middle of the slope or block the slope without reason. When you wish to stop, please move to the side of the slope.

8.9 Only those who can stop, slow down (control speed) and complete ‘s’ shaped turns are to use the platter lifts on the sides of the building. You must be able to give way to those below you on the slope.

8.10 The Snow Dome should be taken in stages, gaining experience as you progress up the slope. Do not go straight to the top.

8.11 Toboggans and tubes are only allowed in designated areas inside Winter Wonderland.

8.12 Helmets are compulsory at all times when skiing, snowboarding, tubing or tobogganing in the Snow Dome; and are provided free of charge for all non-promotional hourly passes (2-hour, 4-hour & 5-hour Snow Passes as well as 1-hour & 2-hour Winter Wonderland Passes). Helmets are not provided free of charge to membership holders (Gold, Silver & Bronze) and with some special promotional passes, unless otherwise stated. If you do not own a helmet, you will be required to hire one for $8. Other Rental Safety Equipment is also available for hire and subject to availability on the day of your visit.

8.13 Strictly no food, drink or smoking, including e-cigarettes, will be tolerated in the Snow Dome.

8.14 Any customers judged to be intoxicated or under the influence of drugs or alcohol will not be allowed in the Snow Dome.

8.15 Only instructors authorised by Snowplanet are permitted to teach lessons in the Snow Dome.

8.16 All first aid use and injury incidents must be reported to the Shift Operations Manager or at the front desk. Should you require first aid treatment on the snow, and are unable to seek help, stay where you are and help will come to you.

8.17 Know your physical condition and limits. If you believe your health could be at risk for any reason, or that you could aggravate a previous condition of any kind by participating in any activity on snow, do not participate.

8.18 Photography and filming may occur within the Snowplanet facility from time to time by Snowplanet, its partners, media organisations, or members of the public. Casual photography and filming for personal, non-commercial use is generally permitted, provided it does not interfere with Snowplanet operations, safety, or the enjoyment of other guests.  The use of professional filming equipment, tripods, lighting, stabilising rigs, or any equipment that may obstruct the slope, Snow Dome, or public areas requires prior approval from Snowplanet.  Commercial filming, organised photo shoots, or the creation of promotional, sponsored, or commercial content within the Snowplanet facility requires prior written approval from Snowplanet.  The use of drones, remote-controlled aircraft, or similar devices anywhere within the Snowplanet facility is strictly prohibited unless expressly authorised by Snowplanet.  Snowplanet reserves the right to restrict, stop, or remove any filming, photography, or equipment that it considers unsafe, disruptive, or unauthorised.

10. SPECIFIC T&CS FOR PRIVATE LESSONS

10.1 Private Lessons are dependent on availability. It is essential to book in advance. A $5 administration fee will be levied per lesson if you wish to request a specific instructor.

10.2 When booking a lesson, a 50% deposit must be paid. Private Lessons, unless otherwise stated, do not include a Snow Pass. This will need to be purchased additionally to your lesson. Full payment of any remaining balance is required prior to the lesson being taken.

10.3 When notice of cancellation or change is within 24 hours prior to the lesson/activity taking place no refund/credit will be given. If you do not show up for the lesson no credit or refund on the deposit will be given.

10.4 If you provide 24 hours or greater notice of change or cancellation of a lesson the deposit can be transferred to credit or refunded.

10.5 Only instructors authorised by Snowplanet are permitted to teach lessons in the Snow Dome.

11. SPECIFIC T&CS FOR BIRTHDAY PARTIES

11.1 Birthday Parties can be booked at Snowplanet and are subject to availability. It is essential to book in advance. When booking a Birthday Party a deposit of $100 must be paid.

11.2 For amendments to dates and times made up to 48 hours prior to the Birthday Party booking time no charge will be incurred. If cancelled, a full refund or credit of the deposit will be given.

11.3 For amendments to dates and times made up to 24 hours prior to the Birthday Party booking time a $20 charge will be incurred. If cancelled, $20 will be deducted from the refund of the deposit.

11.4 For amendments to dates and times made within 24 hours of the Birthday Party booking time a $50 charge will be incurred. If cancelled, $50 will be deducted from the refund of the deposit.

11.5 A minimum number of 6 children per birthday party applies. Price per child rates apply to any additional children. An increase to the number of children attending the party is allowed subject to availability. Participant numbers may be increased or decreased without penalty.

11.6 Chalet booking cancellations made at least seven (7) days prior to the booking date will be eligible for a full refund. Cancellations made less than seven (7) days prior to booking date will be eligible for a 50% refund.

12. SPECIFIC T&CS FOR WORKSHOP SERVICES

12.1 In servicing your skis and snowboards, you agree that the services are provided on an ‘as is’ basis by Snowplanet and that the services are carried out at the Customer’s risk. Snowplanet warrants all reasonable skill and care will be taken in undertaking those services. Any equipment in a state of severe disrepair or over 10 years old may not be serviceable.

12.2 We recommend you check your ski and snowboard equipment and settings (edges, top sheets, binding plates, and binding settings) prior to use at all times, especially after work has been carried out on your equipment.

12.3 Any property left with Snowplanet that remains unclaimed for more than 30 days (other than by arrangement) will be disposed of or recycled. At this time Snowplanet shall have no liability to the Customer or any third party.

12.4 Snowplanet’s liability with respect to Workshop Services, including any negligence on its part, shall be limited to the contract price for the Services. The sole remedy for unsatisfactory work shall be a refund of the amount paid by the Customer or a further additional service of the same value.

13. SPECIFIC T&CS FOR VOUCHERS & COUPONS

13.1 Snowplanet Gift Vouchers

Snowplanet monetary gift vouchers can be used against snow activities, retail purchases and in the Snowplanet 7 Summits Restaurant & Bar.

If you do not spend the full value of the gift voucher, gift vouchers will be provided as change to the nearest dollar.

Gift vouchers are valid for the minimum period required by New Zealand law from the date of purchase, unless otherwise stated. The validity period cannot be shortened.

Gift vouchers can be redeemed online, or at Snowplanet on the date of your visit.

Snowplanet treats gift vouchers as cash, and therefore does not accept liability for lost or stolen vouchers.

Snowplanet reserves the right to amend the terms and conditions of gift vouchers at any time, subject to applicable consumer law.

Gift vouchers are issued with a monetary value, not as a guarantee of a specific product at a fixed future price. If the price of the selected product or service has increased since the voucher was purchased, the customer will be required to pay the difference at the time of redemption. If the price has decreased, any remaining balance will remain on the voucher for future use.

13.2 Snowplanet Coupons

Coupons are only redeemable against the product stated on the coupon.

Coupons are valid for the minimum period required by New Zealand law from the date of purchase, unless otherwise stated. The validity period cannot be shortened.

Coupons can be redeemed online, or at Snowplanet on the date of your visit.

Snowplanet treats coupons as cash, and therefore does not accept liability for lost or stolen coupons.

Snowplanet requires bookings for certain coupons. Snowplanet may not have availability for your product, and reserves the right to refuse redemption unless a prior booking has been made.

Snowplanet reserves the right to amend the terms and conditions of coupons at any time, subject to applicable consumer law.

Where a coupon relates to a promotional offer that has since ended, the coupon will be redeemed as a credit equal to the amount paid, rather than as a guarantee of the originally advertised product or price.

13.3 BookMe and Other Third-Party Coupons

Bookings made through BookMe or any other third-party platform are subject to Snowplanet’s Cancellation, Refund and Late Arrival Policy set out in Section 14 of these Terms & Conditions.

Where a booking is made through a third-party platform:

• Snowplanet determines whether a refund or reschedule is authorised in accordance with its policies.

• The third-party platform administers any approved refund or change in line with its own processes and fees.

• Snowplanet does not process refunds on behalf of third-party providers.

Third-party vouchers or coupons are redeemable only for the product, date, and time stated, and within any validity period specified, subject to minimum consumer protections required by New Zealand law.

Where a booking is required for redemption of a third-party voucher, Snowplanet reserves the right to refuse redemption if no booking has been made in advance or if no availability exists for the requested date or time.

Third-party vouchers are redeemed based on the value paid, not as a guarantee of a fixed future price. If the current price of the product has increased, the customer may be required to pay the difference. If the price has decreased, any remaining balance will remain as credit unless otherwise stated by the issuing provider.

14. CANCELLATION, REFUND & LATE ARRIVAL POLICY

14.1 Application

Unless otherwise specified in product-specific terms (including Private Lessons, Birthday Parties, Programs or Memberships), the following booking cancellation and rescheduling rules apply to Snowplanet passes and activities.

These rules apply to bookings made directly with Snowplanet and bookings made through third-party platforms such as BookMe.

14.2 Customer Cancellations

More than 48 hours before the scheduled session start time

• A refund or reschedule may be authorised.

Between 24 and 48 hours before the scheduled session start time

• A reschedule may be authorised.

• Refunds are normally not authorised.

Less than 24 hours before the scheduled session start time

• Refunds and reschedules are normally not authorised.

No-shows

• Refunds and reschedules are not authorised.

14.3 Late Arrivals

Customers arriving late may be admitted up to 30 minutes after the scheduled session start time, subject to capacity.

Admission is not guaranteed and session time will not be extended.

Arrival more than 30 minutes after the scheduled session start time will be treated as a no-show.

This late arrival provision does not apply to day passes, which remain valid for the full time period purchased.

14.4 Illness or Injury

Illness or injury does not normally authorise a refund.

Where illness or injury is notified before the scheduled session start time, Snowplanet may allow a one-time reschedule, subject to the conditions set out in Clause 14.5.

Where illness or injury is notified on or after the scheduled session start time, the booking will be treated as a no-show.

Claims made after the scheduled booking date will not be accepted.

14.5 Bereavement

In the event of a bereavement affecting the customer or an immediate family member, Snowplanet may, at its sole discretion, allow a one-time reschedule of the booking.

Where possible, notice must be provided prior to the scheduled session start time.

Requests submitted after the scheduled session date will not normally be accepted.

Any approved reschedule remains subject to the conditions set out in Clause 14.6.

14.6 Rescheduling Conditions

Where Snowplanet authorises a reschedule, the following conditions apply:

• A booking may be rescheduled once only.

• The rescheduled booking must occur within seven (7) days of the original booking date, unless Snowplanet determines otherwise in exceptional circumstances.

• Reschedules must be for the same product type and session duration.

• Reschedules must remain within the same session classification (weekday, weekend, peak or off-peak).

• A weekday booking may only be rescheduled to another weekday session.

• A weekend booking may only be rescheduled to another weekend session.

• The same session time is not guaranteed.

• All reschedules remain subject to availability at the time of rebooking.

14.7 Travel Disruption

Where attendance is prevented due to:

• Official road or bridge closures

• Government travel restrictions

• Police or Civil Defence directives

• Emergency orders legally restricting movement

Snowplanet may authorise a refund or reschedule.

Where authorities issue travel advice only, but roads remain open and Snowplanet is operating, the standard cancellation rules apply.

15. CONSUMER LAW

15.1 Nothing in these Terms & Conditions limits or excludes any rights customers may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
